Abstract

In the summer of 2022, the Supreme Court will decide in Dobbs v. Jackson Women’s Health whether or not Mississippi’s “Gestational Age Act” violates the Constitution. Under the precedent set in 1973 in Roe v. Wade, abortion is legal until 22-24 weeks’ gestation when fetal viability occurs. The “Gestational Age Act,” bans abortion after 15-weeks’, months before viability. In this thesis I will summarize and evaluate the arguments made before the Court on behalf of the Petitioners and Respondents in the context of American history and the Supreme Court’s abortion precedent. Next, I will evaluate the potential outcomes of Dobbs v. Jackson, and finally, I will offer my own argument for what I believe the Court should decide. Dobbs v. Jackson is a landmark case. The Court’s imminent decision will affect policy and society for years to come.
